The ATF letter says that potatoes are legal so you are good there. If they try to bring up the subject of it being a DD (in the reguard that it is a firearm with a bore of over .5") then mention that A, it isn't a firearm by definition, and B, the ATF letter would exclude it from being a DD, even if it was a firearm, much in the same way that .700 nitro express rounds, etc, are exempt.

All good advice above, good luck in court. How old are you?

There are many laws that I disagree with, example me and friend went to get some .22 for his rifle the salesperson told us that you have to be 21 to buy that round, because its a hand gun round...... so instead we bought a few boxes of 12 gauage shot. He said that it was some lame law to try to keep down gang violence, he laughed when we got the shotgun shells.

When it boils down to it, the cops were doing there job, doing what they thought was the best. laws are made for the general saftey of people. Still sucks.... If you have a clean record I wouldnt lose any sleep over it.

If you did not cause harm to anyone, then you shouldnt get jail. Maybe just a fine.

What part of miami do you live in because i live in brickell/downtown and its a pretty urban area and i shoot right by mc.arthur, the bridge to key biscayne and i shoot at targets and most of the time at the sea i have like 50 miles of clearance. Well back to the topic once i was shoting some wood with marbles and a cop came by and told me that it was very dangerous i whipped out the atf letter and he called his supervisor and he checked with the atf, it took like 30 minutes but he left because I was right so the po-po was a go-go.

As for the topic, odds are you wont get anything worth worrying about. Just play it cool, and as long as theres nothing you are not telling us you are fine.

thnx guys, i recently turned 18 and have no prior arrests. yea i was only shooting potatos, and at a trash pile. it even says it on the paper the cop wrote. but still im scared man. they charged me with a 3rd degree felony, discharging a destructive device. but i checked up and as long as the projectiles are potatos, its not considered a destructive device. so...i hope the charges get dropped. stay posting, thanks

Milhrad i dont know you and you donk know me so dont talk sht because i dont so be quiet. Back to topic, in homestead there are spud gun contests and competitions so i dont think that they are illegal.

Can you believe what we say for once, ive seen so many posts by you saying what the other person said was BS. Ive read on the forums a few people do keep ATF letters on them, I think it was BC im not sure correct me if im wrong. I personally don't carry the letter as it does not apply to New Zealand laws, it says in NZ pneumatics are legal if your over the age of 18 and you don't break other laws with it, e.g blow a whole in your neighboiurs fence.

When I go out shotting my poatao gun I all ways have a copy of the letter with me. Are you going to tell me to stfu?
